Terms of Service

Last updated: October 2026

These Terms of Service govern the use of software applications developed and licensed by Cerbeta Yazılım Bilişim ve Danışmanlık Ltd. Şti. ("Cerbeta", "we", "us", or "our"), collectively referred to as the "Software".

1. Product

Cerbeta provides software applications for business and operational needs. The functionality, supported integrations, and technical requirements of each application are described in its product documentation and the applicable plan.

The Software is licensed, not sold. All intellectual property rights, including source code, software architecture, trademarks, documentation, and related materials, remain the property of Cerbeta or its licensors.

2. License

Subject to payment of the applicable fees and compliance with these Terms, Cerbeta grants the customer a limited, non-exclusive, non-transferable right to install and use the Software for the duration of the active license or subscription.

Unless otherwise agreed in writing, the license does not permit the customer to:

  • copy or redistribute the Software except as required for normal installation or backup;
  • resell, sublicense, lease, or commercially redistribute the Software;
  • reverse engineer, decompile, or attempt to derive the source code except where such restriction is prohibited by applicable law;
  • bypass or interfere with licensing, activation, security, or usage-control mechanisms;
  • use the Software for unlawful purposes or to gain unauthorized access to third-party systems or data.

3. Subscription and Billing

The Software may be offered under subscriptions or other license plans. The applicable license type and subscription period, where relevant, are specified for the selected application and plan.

The applicable price, billing period, taxes, and renewal information are displayed before checkout.

For purchases processed through Paddle, our online order process is conducted by our authorized reseller, Paddle.com. Paddle is the Merchant of Record for transactions processed through Paddle and is responsible for payment processing, applicable transaction taxes, billing-related customer support, and refunds in accordance with Paddle's applicable policies.

Subscriptions may renew automatically unless canceled before the next renewal date, where automatic renewal applies.

4. Software Activation and Access

Paid access may require online activation and periodic license validation.

A valid license or subscription, as applicable to the selected plan, is required for continued access to paid features of the Software.

If a subscription expires, is canceled, or otherwise ceases to grant paid access, paid features may become unavailable. Depending on the application and plan, the Software may revert to available free-tier functionality.

5. Customer Responsibilities and Industrial Use

Depending on the application, the Software may communicate with business systems, external services, or industrial equipment and control systems.

Customers are responsible for:

  • validating their configurations, data mappings, and write operations, including PLC addresses and tags where applicable;
  • implementing appropriate safety controls and operational procedures;
  • ensuring that the Software is used only by authorized personnel;
  • maintaining suitable backups and recovery procedures;
  • testing configurations before use in production environments.

Where the Software is used in industrial environments, it is not intended to replace machine-level safety systems, emergency-stop systems, safety PLCs, or other legally required industrial safety mechanisms.

6. Availability and Updates

Cerbeta may release software updates, improvements, security fixes, and compatibility changes from time to time.

We do not guarantee that every third-party system, device, firmware version, operating system, or network configuration will remain compatible indefinitely.

7. Support

Support may be provided according to the plan purchased or a separate written agreement.

Unless explicitly included in the purchased plan, consulting, custom development, hardware installation, PLC programming, on-site services, and system integration services are not included in the software license or subscription.

8. Customer Data

Customers retain ownership of their data, including operational and machine data where applicable.

Where the Software processes customer data, such processing is subject to our Privacy Policy and applicable law.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Cerbeta shall not be liable for indirect, incidental, special, or consequential losses, including loss of production, revenue, profits, data, or business interruption arising from use of the Software.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

10. Suspension and Termination

Cerbeta may suspend or terminate access where:

  • required by law;
  • there is fraudulent or unauthorized use;
  • the customer materially breaches these Terms;
  • a paid license or subscription is no longer valid.

11. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be published on this page together with the revised effective date.
